...promises more donations, as it tasks Council on library building
By Elo Edremoda

As part of its humanitarian services to society, Rotary International, Ovwian Club has completed a block of four classrooms in Dede Primary School, Orhuwhorun in Udu council area of Delta state.

The school until Rotary's intervention, had incomplete blocks without plastering, a sandy floor, leaking roofs, without ceilings, doors and windows.

Speaking at the project's commissioning Thursday, April 18, the District 9141 Governor, Rtn Adeyemi Oladokun, while emphasizing the organization's commitment to help humanity, promised to facilitate the donation of sands to fill the waterlogged playground of the school.

Oladokun who tasked the local council to rehabilitate another structure in the school's premises to a library, again vowed that Rotary will equip it with books and other necessary materials that can aid learning.

Further encouraging the learners to study hard in order to realize their dreams, the governor said, "it is one thing to want to be a doctor, a nurse, a pilot and so on. But you have to work towards it. It is not tomorrow, it starts today. You must read your books. Your parents have done their parts by sending you to school, they will not help you to read. If you want to be great, the choice is yours."

Recalling the sorry state of the primary school which was a den for "miscreants," the president of the Rotary Club of Ovwian, Rtn Peter Oghoredafe, pointed out that with the rod protectors, Dede Primary School is free from all manner of intruders or interruptions that used to disrupt learning.

He said: "Today, it's a completed building secured for conducive learning. Teachers and pupils are now secured from sunshine, rain, wind, distraction and packing of human waste every morning before the start of classes. They are now proud of the school and more children are turning up to enroll."

He commended his team, including the project chairman, Rtn Moses Uparan for their support in actualizing the task which commenced last December, at a cost of two million naira.

In his remarks, the chairman of Udu council, represented by his vice, Mr. Justice Iyasere, described the project as "assisting government".

Expressing shock at the sight of the heap of refuse behind one of the classroom blocks, he explained that orders had been given to the Department of Environment, by the council boss to clear the rubbish during an earlier visit, just as he assured that they (waste) will be evacuated by the next sanitation exercise.

On her part, the school's head mistress, Mrs Florence Okonye, assured that the facilities will be put to "meaningful use".

Court orders arrest of former AGF, ex Petroleum Minister, four others

An Abuja High Court on Wednesday ordered the arrest of the immediate-past attorney-general of the federation, Mohammed Adoke, a former minister of petroleum resources, Dan Etete, and four others, who were implicated in the Malabu Oil scandal. The warrant was issued by Justice D.Z. Senchi of Jabi Federal High Court, to the Economic and Financial Crimes Commission (EFCC), prosecuting the case.
The EFCC also got a warrant to arrest Raph Wetzels, Casula Roberto, Pujato Stefeno, and Burrato Sebastiano. All the wanted men were meant to be arraigned before Justice Senchi on Wednesday, April 17, 2019 to face charges related to the Malabu Oil Scandal but failed to show up.
The EFCC had since 2017 pressed charges against Shell Nigeria Exploration Production Co. Ltd, Nigeria Agip Exploration Limited, Eni Spa, Raph Wetzels, Casula Roberto, Pujato Stefeno, Burrato Sebastiano, Duazia Louya Etete (aka Dan Etete), Mohammed Bello Adoke, Aliyu Abubakar and Malabu Oil & Gas Limited. All the defendants declared wanted had repeatedly failed to appear before the court.
In view of their persistent absence in court, the EFCC had through its counsel, Aliyu Yusuf, brought a motion ex parte praying the court for a warrant of their arrest, and an order for leave to execute the warrant outside of the jurisdiction of the court.
The anti-graft agency said the charges bordered on the fraudulent allocation of the Oil Prospecting Licence 245 and money laundering involving the sum of about $1.2bn, forgery of bank documents and bribery. The alleged $1.2bn scam involved the transfer of the OPL 245 purportedly from Malabu Oil and Gas Limited to Shell Nigeria Exploration Production Co. Limited and Nigeria Agip Exploration Limited.
The three companies are defendants in the charges pending before the Federal High Court in Abuja.
At Wednesday’s proceeding, Justice Senchi, granted the prayers of the EFCC, and ruled that the Nigeria Police, the INTERPOL and any other law enforcement agency should arrest them anywhere they were found including outside jurisdiction of the Federal Capital Territory, (FCT) High Court. The matter was adjourned till July 11, 2019 for further hearing.

Ogboru not known to law as APC governorship candidate--- Oghenesivbe.
..Says the nullification of Jones Erue's faction primaries results is enough ground to quash the petition.

By success Ebahor

The embattled and sacked governorship candidate of the All Progressives Congress (APC), in Delta State, Great Ovedje Ogboru lacks "locus standi" at the Delta State Governorship Election Tribunal due to the subsisting court orders contained in the ruling of Justice Toyin Adegoke of the Federal High Court Asaba; and upheld in the Victor Ochei matter by Justice Nnamdi Dimkpa, which nullified the 2019 primaries and election victory of candidates produced by the Jones Erue faction of the party.

A lawyer and Executive Assistant on Communications to the Governor of Delta State, Dr Fred Latimore Oghenesivbe, in his legal opinion contained in a statement made available to newsmen in Asaba said, as it is today Ogboru is not known to law as the 2019 governorship candidate of APC in the State, pointing out that the doors of the tribunal must be shut against the petitioner and all other candidates presented for elective positions by Erue's faction.

He noted that to have a "cause of action" the legal rights must exist and the petitioner must establish that he or she is directly affected by the results declared by the Independent National Electoral Commission (INEC) so as to enjoy the legal principle of fair hearing.

Gov. Okowa's EA on Communications and Fellow of the Civilian Institute of Democratic Administration (FCIDA), further posited that Ogboru stand to be treated as a "political leper and candidate not known to law" by the election tribunal and reasonably deserves nothing but outright denial of right of fair hearing.

Oghenesivbe further asserted that the Court having nullified the 2019 Erue faction primaries and Ogboru being the sacked governorship candidate of APC in Delta State, as contained in the ruling of Justice Toyin Adegoke and upheld by Justice Nnamdi Dimkpa in the Victor Ochei matter, one of the legal consequences is that the petitioner can no longer refer to himself as the 2019 governorship candidate of APC in Delta State.

"It is laughable for Ogboru to file petition at the tribunal challenging the results of the election after a court of competent jurisdiction nullified his candidacy occasioned by illegal primaries which was conducted by a non-existent Erue party exco as clearly stated in the ruling of my Lord, Justice Adegoke.

"Ogboru's candidacy is not known to law based on the Court subsisting orders declaring the Cyril Ogodo faction as the legitimate and authentic state exco of APC in Delta State, and subsequently declared the election victory of all candidates presented by Erue faction for the 2019 general elections NULL and VOID and of no effects whatsoever.

" The law is now very clear and explicit that Ogboru lacks locus standi to file a petition referring to himself or APC referring to him as the 2019 governorship candidate of APC in Delta State, because the court orders contained in the judgment are valid and subsisting since no appeal has been filed, heard  and determined in the matter.

"The governor who has been returned elected in Delta State, Senator Dr Ifeanyi Arthur Okowa, won the election with overwhelming result because of his visionary leadership, prudent management of state financial resources, open door policy, transparency in governance, accountability; quality health Programmed and policies backed by social insurance scheme, substantial and sustainable jobs and wealth creation, sports infrastructure development, giant strides in the education sector, improved inflow of Foreign Direct Investments, massive roads infrastructure like never before, to mention but a few," Oghenesivbe added.
